Florida Attorney General Seeks Emergency Injunction Against OpenAI Models

On September 28, 2026, Florida Attorney General James Uthmeier filed a 49-page emergency motion in Highlands County seeking a temporary injunction against OpenAI and Sam Altman. In the filing he wrote defendants "have asked the government to tie them to the mast," citing Altman's own calls to slow development, and asked the court to require independent safety guardrails before new models, curb practices involving children's data, and stop marketing ChatGPT as safe or human. The move follows a June 1 lawsuit alleging deceptive trade practices, negligence, defective design, failure to warn, and public nuisance, after Judge Aileen Cannon remanded the case from federal court. A criminal probe began in April 2026 over the 2025 Florida State University shooting; the suspect allegedly used ChatGPT beforehand. Contested: Uthmeier says OpenAI will not protect Florida families and links the product to serious harms. OpenAI said the FSU shooting was a tragedy but ChatGPT is not responsible, calling it a general-purpose tool used by hundreds of millions with ongoing safeguard work. The injunction request has not been ruled on.
