Oracle Seeks Force Majeure Protection for $165B New Mexico Data Center
Oracle sent a force majeure notice to a Blue Owl Capital development unit on Project Jupiter, its planned $165 billion New Mexico data center. The 1,400-acre campus is cited at 2.45GW to 2.5GW and due online in 2028. Oracle was named tenant in January 2026. Stack Infrastructure and BorderPlex Digital Assets are building it; Blue Owl bought Stack in 2024. Reports say the notice seeks delayed payments if the site misses 2028 rather than ending Oracle's tenancy. State officials rejected a natural gas pipeline extension in July after a March denial. Oracle had asked federal regulators to fast-track pipeline service by August 15, then issued an RFP for 2GW of new New Mexico renewables and up to $1 million for carbon capture research. On X, Oracle said: "Project Jupiter remains on our planned schedule. We are fully committed to New Mexico and confident in our path forward." It cited more than $4.7 billion in expected economic benefit. Blue Owl said the notice does not change its financial commitments. Oracle shares fell after the Bloomberg report. CONTESTED: Outlets put the share drop near 5% to 7%. Effects on the 2028 schedule and payments remain unresolved.
